OVERVIEW This website is operated by GRIFFIN Construction Parts (a division of GRIFFIN GROUP Inc.). Throughout the site, the terms “we,” “us,” and “our” refer to GRIFFIN Construction Parts. We offer this website, including all information, tools, and services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including those additional terms and conditions and policies referenced herein (specifically our Shipping & Refund Policies).

SECTION 1 - ONLINE STORE TERMS By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

SECTION 2 - GENERAL CONDITIONS We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

SECTION 3 - INDUSTRIAL EQUIPMENT & FITMENT DISCLAIMER

Fitment Responsibility: While we provide expert advice, it is ultimately the customer's responsibility to verify that the part or attachment ordered is compatible with their specific machine make, model, and configuration (including coupler dimensions and hydraulic flow rates).

Machine Modifications: We are not responsible for fitment issues on machines that have been modified, altered, or retrofitted with non-OEM parts.

Technical Data: Specifications, weights, and dimensions provided on the site are based on manufacturer data. We are not liable for minor discrepancies in manufacturing tolerances.

The user acknowledges that heavy machinery attachments (including but not limited to mulchers, augers, and cutters) are inherently dangerous. GRIFFIN Construction Parts is not liable for any bodily injury, death, or property damage resulting from the improper use, lack of safety guards, or failure to follow the manufacturer's safety manual. The customer is solely responsible for ensuring all operators are trained and that the carrier machine has the necessary safety enclosures (e.g., shatterproof forestry doors).

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

All prices are displayed in the currency selected by the user (USD or CAD). If a refund is issued, it will be processed in the original currency of the transaction. We are not responsible for differences in refund amounts due to exchange rate fluctuations or fees charged by the customer’s bank or credit card issuer.

SECTION 5 - SHIPPING & DELIVERY (HEAVY FREIGHT)

Unloading Responsibility: For heavy equipment and attachments shipped via freight (LTL/FTL), the customer is solely responsible for providing the necessary equipment (forklift, skid steer, loading dock) to offload the shipment safely.

Refused Deliveries: If a shipment is refused or undeliverable due to the customer’s inability to unload, the customer will be liable for all shipping charges (both ways) plus a 20% restocking fee.

SECTION 6 - BILLING AND ACCOUNT INFORMATION We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. If we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

SECTION 7 - WARRANTY DISCLAIMER

Authorized Dealer Status: GRIFFIN Construction Parts acts as an authorized distributor for various manufacturers (including WAM Group, Stinger Attachments, etc.).

Manufacturer Warranty Only: All products are sold subject only to the warranties provided by their respective manufacturers. Griffin Construction Parts makes no independent warranty, express or implied, regarding the durability, suitability, or life-expectancy of wear parts or attachments.

No Consequential Damages: We are not liable for downtime, lost profits, or machine damage resulting from the failure or delay of any part supplied.

SECTION 8 - THIRD-PARTY LINKS Certain content, products, and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

SECTION 10 - PERSONAL INFORMATION. Your submission of personal information through the store is governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice.

SECTION 12 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of British Columbia, Canada. You irrevocably consent to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for any legal action arising out of these Terms or your use of the Service, regardless of your country of origin.

SECTION 13 - CHANGES TO TERMS OF SERVICE By placing an order, you agree to contact GRIFFIN Construction Parts directly to resolve any billing disputes or return requests before initiating a chargeback with your credit card issuer. If you file a chargeback for a delivered item, or for a return that was refused due to non-compliance with our Return Policy (e.g., used items), we reserve the right to dispute the chargeback with full evidence of delivery and terms acceptance. Any account with a fraudulent chargeback or unpaid balance may be sent to a third-party collections agency, and you will be liable for all associated legal and collection fees.
